Ello all, aku nak buat luahan rasa sikit. Huhuhu, sedeh di hati ini neh.
This morning I went to Proton to collect my offer letter from them. Sampai sana the HR officer was in a meeting, so she gave me the offer letter for me to read first and will entertain me later for any q&a. So I gave a screening, check the salary offered, the job grade and bla bla. So after waiting like an hour ada sorang HR datang.
So tanya itu ini begitu begini, I asked about maternity. Since Im 6 months pregnant, the maternity will be cover or not. Terus HR tuh cam tergamam jap (at that time ku wonder takkan dier tak nampak my perot kan???). Pastu dia cam serba salah, katanya kene masuk dalam and tanya the manager apa kene buat. Masa tu aku dah rasa tak sedap hati.
After a few minutes waiting, he did come back with another clique. Upon the HR tuh duduk jer, dia terus cakap....WE NEED TO RETRIEVE BACK THE OFFER. OUR POLICY DO N OT HIRE PREGNANT WOMAN. WE DO NOT BEING DISCRMINATE BUT ITS OUR POLICY
And depan2 mata aku, my offer letter teros kene amik. Tergamam, terkejut & speechless. The HR tanya kenapa aku tak bgtau awal2. And I was likeee.....apa bendanya tak bgtahu awal. I declared my pregnancy in the interview form. I never hide anything. The simple answer gave by the HR?? Oooo terlepas pandang laaa tu.
I just couldnt understand. Im only pregnant, not mentally retarded.
Takpelah, rezki untuk aku Insya Allah ada dimana2. Anak dalam perut nie pon rezeki dari Allah jua. And rezki bukan in money ajer kan? Good health, good family & good friends also considered as rezki.

thats very sad and alarming as it was done by a so called government link company.
I think ada kes yang camni penah masuk court.
if i was not mistaken nama case tu Beatrice v. MAS.
Pasal stewardess yang kena berhenti sbb pregnant. but in her case, she already secured a job but was retrenched later. so she relied on Article 8 of the Federal constitution to say that MAS action was discriminatory.
Unfortunately her action failed because court kata article 8 is a constitutional law. Constitutional law, as a branch of public law, deals with the contravention of individual rights by the Legislature or the Executive or its agencies and does not extend its to infringements of an individual' s legal right by another individual. Like wise in this case, Proton eventhough is a GLC but in legal perspective, they are still a saperate entity from the Government (being the Legislature and Executive).
So kira kalau la kes ni masuk mahkamah Court akan cakap its a dispute between an individual with another individual . So Court kata dia tokleh cite discrimination issue.
Aku tak sure ko paham ke tak sbb nih mmg purely contitutional law punya arguments. Maybe others may want to share their knowledge in this. Anyhow, In a nutshell, mmg unfair but agak susah nak claim under discrimination.
Takpe MISS S, ko tabah je k..rezeki anak ada kat mana-mana... .
the best thing kalu ko nak buat, hehehhe....ko tulis je dalam suratkhabar bertapa poyonya kita beriya citer pasal masyarakat penyayang tapi when it comes to implementation its the opposite.
Ko sabar k...kesihatan lagi penting. jgn stress...

sbenanye, kat tpt aku keje pon camtuh, tp die takla tarik balik offer letter tuh, die tukar date for posting tu to sampai time ko dah habis pantang sume....aku rasa that is more fair....agak x fair jugak ko nak keje 3-4 bulan jek, pastuh nak claim utk pregnancy cover sume without knowing the staff will stay ke or skalik blah ke kan.....tp company tuh pon, takleh la tarik balik offer letter gitu jek dgn alasan bodoh camtuh...ape ke benggongnye HR company tuh
kalau aku kat tpt dia and still cam ade hati nak keje situ, aku try to negotiate utk dptkan posting date lepas habis pantang sume....settle, start afresh sume...heheh

aku rase in her case, dia terkedu kot bile happy2 nak amek offer letter, tetibe ditarik balik. kalo aku, konfem takbleh bepikir apepe dah. tableh nak becakap sbb tahan airmate drpd jatuh depan diorg. gittew. masok kete, burst giler babi. cewah.
bak kate imah, boleh sue kampeni ni dgn alasan kite depressed with the decision yg tetibe. :D

kurang ajar proton...kalu ye pun berhemah la sket..camne la org x sumpah sranah company tu...mmg x maju la selama2 nye

aku rase xder ah sampai all the staff takbleh pregnant, and aku rase owwe's point mengenai diorg tanak ah rugi tanggung maternity staff yg baru 2-3 bulan keje yg blom diketahui kesetiaannyer tuh.
tapi, diorg patot nye re-discuss the situation kan, tableh main tarik2 sesukehati, its about people's feeling too.
kalau aku, aku rebut balik surat offer tu pehtu ugut gi lawyer. then again, tak kuasa aku nak turun naik court.
perhaps it wasnt meant to be. mungkin die akan dpt keje yg lebey baik lepas ni, gaji 20k, banglo sebijik dgn swimming pool, overseas vacation 2x setahun... siape tau.
aku doakan miss S dapat keje 10000X lagi baik dari kat proton tu. Dapat kat rival proton adalah lebih afdallll. haha.

Hehhee, here is some explanation
1) I did try for negotiation. I dont mind if they not cover me for maternity and willing to take unpaid leave since ku sedar im still under probation and not nice to use their benefit. As per owwe said, mana tahu if lepas beranak ku lompat keje? waste on their sidelah kan. But still they insist not to offer me the job
2) There is no mutual agreement that they will take be back after my confinenment. What the HR said was, to call him back once I start my job back. If the vacancy still there, so rezki ku utk keje sana. But kalau takde, paham2 aje :) So mmg takde hitam putih yang mengatakan Proton will hire me. Just janji from HR (mungkin nak tebus rasa bersalah ngan kata2 manis). Itu ajerla
